The Mercury Trust/Saul Fox v. Porsche Cars North America, Inc.

04/30/07 Lemon Law Case No.: 206-0168/FTL A $610,000 Lemon!

A prominent California businessman and automobile aficionado purchased this 2004 Porsche Carrera GT with the intent of enjoying its fine engineering and race-bred handling. Unfortunately, an irreparable engine oil leak along with other minor problems resulted in the vehicle being out of service for over 100 days. A new, non numbers-matching engine was sourced from Germany, but the repair was not completed in time.

Cousins Law Firm represented the Consumer in Porsche's dispute settlement program of choice, the National Center for Dispute Settlement, lost, and appealed to the Florida New Motor Vehicle Arbitration Board. The Board unaminously found in the Consumer's favor. The Board held: "There was no dispute that the defects complained of by the Consumer substantially impaired the use, value, and safety of the vehicle[.]" Porsche was ordered to pay the Consumer $567,138.89. It has been verified with the Florida Attorney General's Office that this is the largest Lemon Law refund in Florida history.
