David Popham v. Mercedes-Benz USA, Inc.
Lemon Law Case No. 2006-0332/MIA A $494,000 Lemon!
A highly successful real estate agent dealing in high end luxury homes in Miami and the Palm Beaches purchased a 2005 Mercedes-Benz SLR McLaren to add to his fleet of luxury and sports automobiles, many of them Mercedes-Benz automobiles. The SLR McLaren suffered various problems which kept it out of service for over 30 days.
In addition to its attorney, Mercedes-Benz brought four people to the arbitration to testify against the Consumer. After over a dozen hours of arbitration, Mercedes-Benz ultimately agreed that the SLR McLaren was a Lemon. Mercedes-Benz was ordered to refund the Consumer $180,315.85. The Consumer has since purchased more Mrecedes-Benz automobiles, but will not buy a SLR McLaren again.
