Fischetti v. Isuzu Motors Corp.

Case #4D05-2439 in the Florida Fourth District Court of Appeal.

Isuzu sued the Consumer of an automobile with defective paint, after the Consumer won his Lemon Law arbitration against them. The manufacturer ultimately made the argument that automobile makers occasionally put forth: that the Consumer’s rights are only against the dealer who sold the car, and not the Manufacturer.

Cousins Law Firm represented the Consumer’s rights and the Court of Appeals ruled that the Consumer does have rights directly against the Manufacturer. The Cousins’ client was allowed to sue the Manufacturer for his bad paint job.
